Subject of the Contract
This contract regulates the sale of new goods and services through the provider’s online shop. For details of the respective offer, please refer to the product description on the offer page.
Conclusion of Contract
The contract is concluded in electronic commerce via the shop system or through other means of distance communication such as telephone and email. The offers displayed represent a non-binding invitation for the customer to submit an offer through their order, which the provider can then accept. The ordering process for concluding the contract in the shop system includes the following steps:
- Selection of the offer in the desired specification (size, color, quantity)
- Placing the offer in the shopping cart
- Clicking the ‘order’ button
- Entering the billing and delivery address
- Selection of the payment method
- Checking and processing the order and all entries
- Clicking the ‘order with cost obligation’ button
- Confirmation email that the order has been received
In addition to the shop system, orders can also be placed via means of distance communication (telephone/email), whereby the ordering process for concluding the contract includes the following steps:
- Call to the order hotline / Sending the order email
- Confirmation email that the order has been received
The contract is concluded when the order confirmation is sent.
Contract Duration
The contract is concluded for an indefinite period.
Retention of Title
The delivered goods remain the property of the provider until full payment is made.
Reservations
The provider reserves the right not to provide the promised service in case of unavailability.
Prices, Shipping Costs, Return Costs
All prices are final prices and include statutory VAT. In addition to the final prices, depending on the shipping method, further costs may be incurred, which are displayed before the order is sent. If there is a right of withdrawal and this is exercised, the customer bears the costs of return shipping.
Payment Terms
The customer has exclusively the following payment options: Direct debit, Payment service provider (PayPal), Cash payment on collection, Credit card. Other payment methods are not offered and will be rejected.
The invoice amount is collected by the provider via direct debit procedure based on the direct debit authorization by the customer from their specified account. When using a trustee service/payment service provider, this enables the provider and customer to process the payment between each other. The trustee service/payment service provider forwards the customer’s payment to the provider. Further information can be found on the website of the respective trustee service/payment service provider. The invoice amount can also be paid in cash in the provider’s business premises during normal office hours, minus the shipping costs charged. For credit card payments, the customer must be the cardholder. The credit card will be charged after the goods are shipped. The customer is obliged to pay or transfer the amount shown on the invoice to the account specified on the invoice within 14 days of receipt of the invoice. Payment is due without deduction from the invoice date. After expiry of the payment deadline, which is thus determined by calendar, the customer is in default even without a reminder.
Delivery Conditions
The goods will be shipped immediately after confirmed receipt of payment. The shipment takes place on average no later than 14 days. The entrepreneur commits to delivery on the 21st day after receipt of order. The standard delivery time is 10 days unless otherwise stated in the item description. The provider does not ship directly. The order is shipped by the manufacturer as soon as the entire order is in stock there. The customer will be informed immediately about any delays.
Warranty
If the customer is an entrepreneur, the warranty period for new goods is limited to one year. If the customer is an entrepreneur, the warranty for used goods is excluded. If the customer is a consumer, the warranty period for used goods is limited to one year. This does not apply to the customer’s claims for damages due to injury to life, body, health, or essential contractual obligations which must necessarily be fulfilled to achieve the purpose of the contract. Likewise, this does not apply to claims for damages after grossly negligent or intentional breach of duty by the provider or its legal representative or vicarious agents. In all other respects, the statutory provisions apply.
Contract Design
The contract text is stored by the provider. The customer has no possibility to directly access the stored contract text. The customer can correct errors in the input during the ordering process. To do this, they can proceed as follows: Via email to Contact@studio-light-style.de, stating the order number.
Right of Withdrawal and Customer Service
The regulations for distance contracts are not applicable to customers who are entrepreneurs. Therefore, these customers are not entitled to a corresponding right of withdrawal due to distance contracts. The provider does not grant such a right either.
Disclaimer
Claims for damages by the customer are excluded, unless otherwise stated in the following reasons. This also applies to the representative and vicarious agents of the provider, if the customer raises claims for damages against them. Excluded are claims for damages by the customer due to injury to life, body, health, or essential contractual obligations which must necessarily be fulfilled to achieve the purpose of the contract. Likewise, this does not apply to claims for damages after grossly negligent or intentional breach of duty by the provider or its legal representative or vicarious agents.
Language, Jurisdiction and Applicable Law
The contract is drawn up in German. The further execution of the contractual relationship is in German. The law of the Federal Republic of Germany applies exclusively. For consumers, this only applies to the extent that it does not restrict any legal provisions of the state in which the customer has their residence or habitual abode. In the event of disputes with customers who are not consumers, legal entities under public law or special funds under public law, the place of jurisdiction is the provider’s registered office.
Data Protection
In connection with the initiation, conclusion, processing and reversal of a purchase contract based on these terms and conditions, data is collected, stored and processed by the provider. This is done within the framework of the legal provisions. The provider does not pass on any personal data of the customer to third parties, unless he is legally obliged to do so or the customer has expressly consented in advance. If a third party is used for services in connection with the processing of processing processes, the provisions of the Federal Data Protection Act are observed. The data provided by the customer in the course of the order are processed exclusively for contact within the framework of contract processing and only for the purpose for which the customer provided the data. The data is only passed on to the shipping company that handles the delivery of the goods as ordered, to the extent necessary. The payment data is passed on to the credit institution commissioned with the payment. Insofar as the provider is subject to retention periods under commercial or tax law, the storage of some data can last up to ten years. During the visit to the provider’s online shop, anonymized data that does not allow conclusions to be drawn about personal data and does not intend to do so, in particular IP address, date, time, browser type, operating system and pages visited, is logged. At the customer’s request, personal data will be deleted, corrected or blocked within the framework of the legal provisions. Free information about all personal data of the customer is possible. Severability Clause
The invalidity of a provision of these terms and conditions has no effect on the validity of the other provisions.
